Terms of Service

This text covers the standard subscription / SaaS structure and is written in plain language. It will be reviewed by qualified legal counsel before public launch and may change at that point. Your statutory consumer rights (where applicable) are not affected by anything in this document.
1. Acceptance of terms
By creating an account, downloading the app, or otherwise using Forky (the “Service”), you (“you”, “User”) agree to these Terms of Service (“Terms”) and to our Privacy Policy, which is incorporated by reference. If you don't agree, do not use the Service.
2. About the Service
Forky is a nutrition assistant that helps you scan ingredients, get recipe suggestions, track macros, and sync wearable activity data. Forky is not medical, dietary, fitness, or psychological advice and is not a substitute for a qualified healthcare professional. Calorie targets, macros, recipes, ingredient identifications, and tracking suggestions are generated by AI and may be inaccurate or unsuitable for your situation.
If you have a medical condition, are pregnant or nursing, are recovering from disordered eating, or have specific dietary requirements, consult a doctor or registered dietitian before relying on anything Forky says.
3. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to create an account. By creating an account, you confirm you meet this requirement and that you are legally able to enter into binding contracts.
4. Your account
You are responsible for: (a) the accuracy of information you provide, (b) the security of your login credentials, (c) all activity under your account, and (d) telling us promptly if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms or that pose a security risk.
5. Subscriptions, free tier, and trials
5.1 Free tier. Forky's free tier has daily quotas for scans, imports, and recipe generation. Quotas may change with reasonable notice.
5.2 Forky Pro. The Pro tier unlocks unlimited scans, wearable sync, AI recipe photo generation, and weekly meal plans. Pricing is shown in-app at the time of purchase. Plans available: annual and lifetime.
5.3 Free trials. If you start a free trial, your selected plan begins billing automatically at the end of the trial unless you cancel before then.
5.4 Auto-renewal. Recurring subscriptions renew automatically at the end of each billing period at the then-current price. You can cancel at any time:
Cancellation takes effect at the end of the current paid period — you keep Pro access until then.
5.5 Price changes. We will give you at least 30 days' notice before any price increase to an existing subscription. You can cancel before the new price takes effect.
6. Refunds and consumer rights
All Forky subscriptions are sold exclusively through Apple’s App Store and Google Play. Refunds follow Apple’s and Google’s policies — request refunds through them directly, not through us.
If you are a consumer in the EU, UK, or Switzerland, you have the statutory rights granted by Apple’s and Google’s store policies and applicable consumer-protection law. Apple and Google handle all withdrawal / refund requests.

7. Acceptable use
You agree not to:
We may suspend or terminate your account, with or without notice, for violations.
8. Your content
You retain ownership of the content you submit to Forky — photos, recipes, notes, and tracking entries (“User Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and process User Content as needed to operate the Service (for example, to send a fridge photo to a vision model so we can identify the food). This licence ends when you delete the relevant content or your account, except where we are required by law to retain it longer.
9. AI-generated outputs
Recipes, calorie estimates, ingredient identifications, tracking suggestions, and other outputs (“AI Outputs”) are produced by AI models. AI Outputs:
You use AI Outputs at your own risk. We are not liable for harm caused by reliance on them — see “Limitation of liability” below.
Allergens and dietary restrictions. Forky does NOT reliably detect allergens, cross-contamination, hidden ingredients, or label variations. If you have a food allergy or intolerance, you must read every product label yourself before eating, and you must verify every ingredient identification Forky returns. Forky is not a substitute for label-reading and is not designed for users with severe or life-threatening food allergies.
10. Intellectual property
The Forky name, logo, mascot, app design, and all underlying software are owned by Elie DTDR and protected by intellectual-property law. Nothing in these Terms grants you rights to our IP except the limited right to use the Service while your account is active.
11. Service availability and changes
We aim for high availability but do not guarantee uninterrupted access. The Service is provided “as is” and “as available.” We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice for material changes affecting paid users.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow exclusion of certain warranties — in those, this section applies to the maximum extent permitted.
13. Limitation of liability
To the maximum extent permitted by law, Elie DTDR's total aggregate liability to you for any claim arising from or relating to the Service is capped at the LESSER of: (a) the amount you actually paid us in the 12 months immediately before the claim, or (b) USD 50. This cap applies to all causes of action in the aggregate, whether based on contract, tort, statute, or any other legal theory.
In no event will Elie DTDR, his agents, or service providers be liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, lost data, or business interruption — arising from or relating to the Service.
Nothing in this section limits liability that cannot be limited under applicable law (including liability for fraud, gross negligence, death, or personal injury caused by negligence).
14. Indemnification
You agree to indemnify and hold harmless Elie DTDR from any claims, damages, or costs (including reasonable legal fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.
15. Termination
You can delete your account at any time via Profile → Settings → Delete account. We can suspend or terminate your account at any time for material violations of these Terms or applicable law. On termination, your right to use the Service ends immediately. Sections that by their nature should survive (IP, liability, indemnity, governing law) survive termination.
16. Governing law and jurisdiction
These Terms are governed by the laws of Switzerland. Any dispute arising from or relating to these Terms or the Service will be brought exclusively before the competent courts of the Canton of Vaud (Lausanne), Switzerland — except that, if you are a consumer, mandatory consumer-protection law in your country of residence may give you the right to bring the claim before your local courts.
17. Changes to these Terms
We may update these Terms from time to time. For material changes (e.g. new pricing structure, expanded data use), we will give at least 30 days' notice via email or in-app banner. Continued use of the Service after the change takes effect means you accept the new Terms. If you don't agree, stop using the Service before the change date.
